Federal law limits the actions debt collectors can take when trying to collect money. This law is known as the Fair Debt Collection Practices Act (FDCPA), and it guarantees you certain rights. Under the Fair Debt Collection Practices Act:

  • Congress allows consumers to recover up to $1,000 over and above any actual losses, even when the consumer suffers no actual losses.
  • Congress allows consumers to have their attorney's fees paid by the violating debt collector. As private attorneys general, consumers' attorneys enforce the debt collectors' standard of conduct.
  • Class action suits are authorized. The individuals who successfully bring the suit recover as if they brought an individual claim, but the class members recover up to 1% of the debt collector's net worth.

The goal of a collections agency is to obtain as much of a person’s debt as possible. It is not illegal for a debtor to receive a phone call about this. However, there is a clearly defined law against harassing debtors.

Under the Fair Debt Collection Practices Act, debt collectors cannot:

  • Call you at inconvenient times, such as before 8 a.m. or after 9 p.m.
  • Contact you at work after your employer has forbidden it
  • Provide information about your debt to third parties
  • Harass you
  • Threaten bodily harm
  • Threaten arrest or legal action
